Visa ePortal operates as an independent travel and document assistance service. We are not a government body and have no authority to grant, deny, or influence travel authorisation decisions. All outcomes are determined exclusively by the relevant government authorities.

4. Independent Service Provider

Visa ePortal operates as an independent provider and is not linked to, authorised by, or acting on behalf of any government department, embassy, or consulate. Applicants remain free to submit applications directly via official government websites.

You understand that inaccurate, incomplete, or delayed information may lead to processing delays or refusal. We are not responsible for outcomes arising from information you provide.

6. Fees, Charges, and Refunds

Our service fees are clearly presented before any payment is made and reflect the cost of providing administrative support, document preparation, and application assistance services.

Our service fees include applicable government charges unless otherwise stated. All fees are exclusive of applicable taxes, which will be calculated and disclosed to you at checkout prior to payment.

We currently accept payment via Visa and Mastercard. American Express, Discover, PayPal, bank transfers, and other payment methods are not supported at this time. Full payment is required before any application review, preparation, or submission support begins.

All transactions are processed through secure third-party payment providers. While we take reasonable care in selecting reputable providers, we are not responsible for processing errors, declined transactions, or service interruptions caused by third-party systems, to the extent permitted by applicable law.

Our service fees are generally non-refundable once work has commenced, including where we have begun reviewing your application, preparing documentation, or initiating submission on your behalf, subject to any rights available under applicable consumer protection laws.

If you cancel your request before any substantial work has been performed, you may be eligible for a partial or full refund. Any such requests will be assessed reasonably based on the stage of service delivery.

For individuals located in the United Kingdom and European Union, you may be entitled to cancel certain services within 14 days without providing a reason. However, if you request that we begin delivering the services within this period and confirm your consent, you acknowledge that your right to cancel may no longer apply once the service has been fully completed, to the extent permitted by applicable law.

Where required by applicable law, you may be entitled to a remedy, including a refund or compensation, if our services do not meet applicable consumer guarantees.

For full details regarding refunds, please refer to our Refund Policy available on our website, which forms part of these Terms and Conditions.

As every situation is different, we will reasonably review your circumstances and respond fairly and appropriately in line with applicable requirements.

7. Processing Timelines and Outcomes

Processing timelines and decisions are determined solely by government authorities in Australia, Canada, Vietnam, New Zealand and the United Kingdom. We cannot influence application outcomes.

Delays may arise due to government operational demand, regulatory adjustments, security screening, or document review processes. We do not guarantee approvals, processing timeframes, or outcomes.

8. Limitation of Liability

To the extent permitted by applicable law, our total liability for any claims arising from or in connection with our services is limited to the amount you have paid for the specific service to which the claim relates.

We are not liable for any indirect, incidental, consequential, or special losses or damages. This includes, without limitation, loss of travel opportunities, loss of income, delays, missed flights, or any additional costs incurred as a result of application outcomes or processing times.

All decisions relating to travel authorisations or visas are made solely by the relevant government authorities. We do not accept responsibility for application refusals, delays, or any changes to immigration or travel requirements.

Nothing in this section is intended to limit or exclude any rights or remedies that cannot be lawfully limited or excluded under applicable consumer protection laws.

9. International Consumer Protection Laws and Your Rights

Australia

In Australia, the Australian Consumer Law establishes a national framework for consumer protection and fair trading. It sets out mandatory consumer guarantees that apply to goods and services, including that services must be provided with due care and skill, be reasonably fit for purpose, and be delivered within a reasonable time. These guarantees are designed to ensure that consumers receive services that meet acceptable standards and are protected against unfair or misleading business practices.

When you use our services, you are entitled to these protections where applicable. This means that if our services do not meet the required standard, you may have rights to remedies, which can include a refund, repair, or compensation depending on the circumstances. We do not seek to exclude or limit these rights and will assess any concerns fairly in line with applicable legal requirements.

United Kingdom / European Union

In the United Kingdom and European Union, consumer protection laws are supported by regulations such as the General Data Protection Regulation and related consumer legislation. These laws promote transparency, fairness in contracts, and the protection of personal data. They also establish rights such as the ability to receive clear information about services, fair pricing, and, in certain cases, a 14-day cooling-off period for distance contracts.

Where applicable, you may have the right to cancel certain services within 14 days without providing a reason. However, if you request that services begin immediately and acknowledge this request, your right to cancel may be limited once the service has been fully performed, as permitted by law. We aim to provide clear information and fair service practices in line with these requirements.

Canada

In Canada, consumer protection laws are primarily governed at the provincial level, while privacy obligations are established under the Personal Information Protection and Electronic Documents Act. This framework requires organisations to handle personal information responsibly, obtain meaningful consent, and maintain transparency in how services are offered, including pricing and applicable charges such as taxes.

When using our services, you may have rights relating to fair disclosure of fees, including applicable taxes, and the ability to access and request corrections to your personal information. We aim to clearly communicate all charges before payment and handle your personal data in accordance with recognised privacy and transparency principles.

New Zealand

In New Zealand, consumer protection is governed by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. These laws ensure that services are delivered with reasonable care and skill and that businesses do not engage in misleading or deceptive conduct. They are designed to provide consumers with confidence that services will meet acceptable standards.

Where applicable, you may have the right to remedies if services do not meet these standards, including repair, replacement, or refund, depending on the nature of the issue. You are also protected from misleading representations about our services. We aim to provide accurate information and deliver our services in a manner consistent with these legal expectations.

United States

In the United States, consumer protection and privacy laws are governed by a combination of federal and state-level regulations, which may vary depending on your location. Certain states, including California, provide individuals with specific rights in relation to personal information and consumer protection.

Where applicable, you may have rights under relevant state laws, including rights relating to transparency, access to personal information, and fair business practices. We aim to respect these rights and handle personal information in accordance with applicable legal requirements.

As every situation is different, we will reasonably review your circumstances and respond fairly and appropriately in line with applicable requirements.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia.

You agree that any disputes arising out of or in connection with these Terms or the use of our services shall be subject to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

11. Compliance with Applicable Laws and Severability

Nothing in these Terms and Conditions is intended to restrict or exclude any rights that cannot be lawfully limited or excluded under applicable law.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be adjusted only to the extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Where required by applicable law, certain provisions of these Terms may not apply, or may apply differently, depending on your place of residence. In such circumstances, the relevant local laws will apply to the extent necessary.

12. Force Majeure

We are not responsible for any failure or delay in providing our services where this is caused by circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to, actions or decisions by government authorities, changes to immigration laws or policies, system outages, technical disruptions, natural disasters, public health events, labour disputes, or interruptions to communication or transport systems.

Where such events occur, we will take reasonable steps to resume our services as soon as it is reasonably practicable to do so, to the extent permitted by applicable law.

13. Payments Through Third-Party Providers

To process payments securely, we use trusted third-party payment service providers. When making a payment on our website, you may be redirected to or required to interact with a third-party platform. Any payment you make is processed directly by that provider and is subject to their terms and conditions and privacy policies.

While we take reasonable care in selecting reputable providers and expect them to maintain appropriate security standards, we do not control their systems or operations. As such, we are not responsible for the availability, performance, or security of these services, including any errors, delays, declined payments, or technical issues, to the extent permitted by applicable law.

If you experience any issues with a payment, we encourage you to contact us so we can assist where appropriate. However, the resolution of payment-related issues will remain subject to the processes and policies of the relevant payment provider.

14. Payment Information and Data Accuracy

We will only request payment details after you have completed the required steps and accepted these Terms and Conditions. All payments are processed through secure and certified third-party providers. We do not store full payment card details and do not have direct access to sensitive financial information handled by these providers.

You are responsible for ensuring that payment information is entered accurately and only through authorised and secure channels provided on our website.

You agree to provide accurate, complete, and up-to-date information when using our services. We are not responsible for any delays, refusals, or issues arising from incorrect, incomplete, or outdated information supplied by you, to the extent permitted by applicable law.

Any personal information you provide will be handled in accordance with our Privacy Policy.

If you submit information on behalf of another individual, you confirm that you have obtained their consent and that they understand how their information will be used. Where the individual is under 18 years of age, you confirm that you are their parent, legal guardian, or otherwise authorised to act on their behalf.
